Each time one of the individual pages of this website is called up, which is operated by the person responsible for processing and on which a YouTube component (YouTube video) has been integrated, the Internet browser on the information technology system of the person concerned is automatically activated by the respective YouTube component caused to download a representation of the relevant YouTube component from YouTube. As part of this technical process, YouTube and Google are informed which specific subpage of our website is visited by the person concerned.

If the person concerned is logged in to YouTube at the same time, YouTube recognizes which specific subpage of our website the person concerned is visiting by calling up a subpage that contains a YouTube video. This information is collected by YouTube and Google and assigned to the respective YouTube account of the data subject.

YouTube and Google always receive information via the YouTube component that the person concerned has visited our website if the person concerned is logged in to YouTube at the same time as accessing our website; this takes place regardless of whether the data subject clicks on a YouTube video or not. If the data subject does not want this information to be transmitted to YouTube and Google, they can prevent the transmission by logging out of their YouTube account before accessing our website.

13. Legal Basis for Processing

Art. 6 I lit. a DS-GVO serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in the case of inquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data could become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and fundamental freedoms of the person concerned do not prevail. Such processing operations are permitted to us in particular because they have been specifically mentioned by the European legislator. The criterion for the duration of the storage of personal data is the respective statutory retention period. After the deadline has expired, the corresponding data will be routinely deleted, provided that they are no longer required to fulfill the contract or to initiate a contract.

2   Werden Ihre Daten an Länder außerhalb der Europäischen Union (sog. Drittländer) übermittelt?

 

Länder außerhalb der Europäischen Union (und des Europäischen Wirtschaftsraums

„EWR“) handhaben den Schutz von personenbezogenen Daten anders als Länder innerhalb der Europäischen Union. Für die Verarbeitung Ihrer Daten setzen wir auch Dienstleister ein, die sich in Drittländern außerhalb der Europäischen Union befinden. Es gibt aktuell keinen Beschluss der EU-Kommission, dass diese Drittländer allgemein ein angemessenes Schutzniveau bieten.


 

Wir haben daher besondere Maßnahmen getroffen, um sicherzustellen, dass Ihre Daten in den Drittländern ebenso sicher wie innerhalb der Europäischen Union verarbeitet werden. Mit Dienstleistern in Drittländern schließen wir die von der Kommission der Europäischen Union bereitgestellte Standard-Datenschutzklauseln ab. Diese Klauseln sehen geeignete Garantien für den Schutz Ihrer Daten bei Dienstleistern im Drittland vor.

 

Unsere Dienstleister in den USA sind darüber hinaus nach dem EU-US Privacy Shield- Abkommen zertifiziert.

1                      Wie lange werden meine Daten gespeichert?

 

Wir speichern Ihre personenbezogenen Daten, solange es zur Erfüllung unserer gesetzlichen und vertraglichen Pflichten erforderlich ist. Ihre Daten werden sodann gelöscht, es sei denn, deren Weiterverarbeitung ist zu folgenden Zwecken erforderlich:

 

-       Erfüllung handels- und steuerrechtlicher Aufbewahrungspflichten, die vorhersehen, dass Ihre personenbezogenen Daten längstens 10 Jahre nach Beendigung des Vertragsverhältnisses aufbewahrt werden müssen.

-       Erhaltung von Beweismitteln im Rahmen der gesetzlichen Verjährungsvorschriften. Nach den Verjährungsvorschriften der lokalen Gesetze können diese Verjährungsfristen in manchen Fällen bis zu 30 Jahre betragen, die regelmäßige Verjährungsfrist beträgt drei Jahre.

 

2.          Welche Rechte haben Sie im Zusammenhang mit der Verarbeitung Ihrer    Daten?

 

Jede betroffene Person hat das Recht auf Auskunft nach Art. 15 DSGVO, das Recht auf Berichtigung nach Art. 16 DSGVO, das Recht auf Löschung nach Art. 17 DSGVO, das Recht auf Einschränkung der Verarbeitung nach Art. 18 DSGVO, das Recht auf Widerspruch aus Art. 21 DSGVO sowie das Recht auf Datenübertragbarkeit aus Art. 20 DSGVO. Beim Auskunftsrecht und beim Löschungsrecht gelten die Einschränkungen nach lokalen Datenschutzgesetzen. Darüber hinaus besteht ein Beschwerderecht bei einer zuständigen Datenschutzaufsichtsbehörde.

 

Widerspruchsrecht

Der Verwendung Ihrer Daten für werbliche Zwecke können Sie jederzeit widersprechen, ohne dass hierfür andere als die Übermittlungskosten nach den Basistarifen entstehen.

 

·       Welches Recht haben Sie im Falle einer Datenverarbeitung aufgrund eines berechtigten oder öffentlichen Interesses?

Sie haben gem. Art. 21 Abs. 1 DSGVO das Recht, aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung Sie betreffender personenbezogener Daten, die aufgrund von Art. 6 Abs. 1 e DSGVO (Datenverarbeitung im öffentlichen Interesse) oder aufgrund Art. 6 Abs.1 f DSGVO


(Datenverarbeitung zur Wahrung eines berechtigten Interesses) erfolgt, Widerspruch einzulegen, dies gilt auch für ein auf diese Vorschrift gestütztes Profiling.

Im Falle Ihres Widerspruchs verarbeiten wir Ihre personenbezogenen Daten nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.

 

·       Welches Recht haben Sie im Falle einer Datenverarbeitung zur Betreibung von Direktwerbung?

Sofern wir Ihre personenbezogenen Daten verarbeiten, um Direktwerbung zu betreiben, so haben Sie gem. Art. 21 Abs. 2 DSGVO das Recht, jederzeit Widerspruch gegen die Verarbeitung der Sie betreffenden personenbezogenen Daten zum Zwecke derartiger Werbung einzulegen, dies gilt auch für das Profiling, soweit es mit solcher Direktwerbung in Verbindung steht.

Im Falle Ihres Widerspruchs gegen die Verarbeitung zum Zwecke der Direktwerbung werden wir Ihre personenbezogenen Daten nicht mehr für diese Zwecke verarbeiten.


Widerruf der Einwilligung

Ihre Einwilligung in die Verarbeitung personenbezogener Daten können Sie jederzeit widerrufen. Bitte beachten Sie, dass der Widerruf nur für die Zukunft wirkt.
